General provisions

The regulations specify the conditions for booking and renting Apartments posted on the www.nearto.pl websites and booking websites. Making a reservation is tantamount to reading and accepting the provisions of the Regulations. Making a reservation also concludes the Apartment Rental Agreement between Nearto.pl and the Customer, under conditions specified in the Regulations and confirmation of the booking.

     1. Checking in

The rental day lasts from 3:00 pm on the day of arrival.

Payment for the stay:

-  When booking through booking websites, payment is guaranteed by credit or debit card.

– When booking via the www.nearto.pl website or by e-mail/phone, a minimum payment of 25% of the booking value is required, within 48h, to the bank account specified in the booking confirmation. The remaining amount for the stay the Client is obliged to pay within the period specified in the booking confirmation. In the event of cancellation, the reservation fee will not be refunded.

Accommodation can take place at the previously agreed time from 3:00 pm. The exact time of accommodation should be determined and confirmed no later than 24 hours before the Customer’s arrival, by e-mail biuro@nearto.pl or phone +48 604 990 650. If the Customer does not confirm the exact arrival time within this period, the Customer agrees to the possible need to wait for the accommodation and handing over the keys.

During accommodation, the client receives the keys to the apartment with instructions on how to use it. In the event of loss, the Customer shall pay a PLN 100 fee for each lost set of keys.

    2. Checking out

Check-out may take place at the previously agreed time until 11:00 am. The exact time of check-out should be determined at the latest at the time of accommodation.

If the customer does not check out at the time previously agreed with the apartment employee, the customer pays a fee of PLN 100 for each 30 minutes delay. If the apartment employee decides that the delay is so great that it disturbs the functioning of the Nearto.pl apartments, in particular the ability to meet their obligations to other Customers, the employee has the right to remove items belonging to the Customer from the apartment. The customer is solely responsible for items left behind and removed from the apartment in this case.

    3. Change of booking date and cancellation
Changing the date of booking/apartment is conditioned by the availability of another selected date or apartment. Changes in the reservation can be made by the Customer up to 3 days before the planned arrival. The change of date/apartment should be confirmed by a NEARTO.PL employee. After making the exchange, the Customer will receive a change in the booking conditions (date/apartment/price) by e-mail.

After the start of the stay, it is not possible to shorten the stay.

If the booking was paid with a tourist voucher. The customer is not entitled to free cancellation of the reservation. Resignation from the stay is associated with the loss of the tourist voucher.

In the case of non-refundable reservations, NEARTO.PL is not obliged to change the date or refund money for canceled reservations.

In the case of long-term reservations (stay at least 28 days), the notice period is at least 14 days.

At the beginning of April 2020, we can assume that our customers are already aware of the risks associated with the COVID-19 virus, as well as the risks of making new bookings, in particular in non-refundable and partially refundable offers. As a result, all new bookings made after April 1, 2020 or later will not be subject to the Emergency Circumstances Procedure for guests wishing to cancel or amend their booking due to the coronavirus pandemic. These bookings will be treated like any other standard booking and will be subject to our standard policies and procedures.

The customer can cancel reservations up to 3 days before the planned arrival. The booking fee is non-refundable

  1.  Equipment of the apartments

The apartments are fully furnished and also have a fully equipped kitchen and bathroom. In addition, each Customer receives a set of bed linen and towels. Most apartments have district heating. The heating of the apartments depends on the heating season of the city of Krakow.

  1. Rules for using the apartments

The Customer receives an apartment with fully functional equipment. Any destruction or damage that the Customer finds in the apartment should be immediately reported to the Nearto.pl employee within 2 hours from the check-in.

The customer of the apartment bears full responsibility for any damage, destruction or missing items of the apartment’s technical equipment and devices arising from his fault or the fault of the people visiting him. In the event of any damage, the customer should notify the employee of the company. Compensation for damages includes losses that the Landlord has suffered, and benefits that he would have been able to achieve if the damage has not taken place.

Nearto.pl reserves the right to chargé a refundable deposit, payable in cash, by card or by bank transfer, in the amount of PLN 300-500/apartment (depending on the type of apartment) during the check-in process, after the apartment has been checked by a Nearto.pl employee, the deposit will be refunded up to 7 days after check-out. The deposit is intended to secure the claims of Nearto.pl in the event of damage or breach of the rules of the stay. On New Year's Eve the amount of the deposit is 500-2000 depending on the type of apartment.

The apartment is used for residential purposes. It is forbidden to organize any receptions, special events, meetings of the number of people greater than those saying in the apartment. For breaking the prohibition, Nearto.pl will chargé a fine in the amount of PLN 1000,00.

The customer is obliged to observe the curfew, safety rules and fire protection of the facility. Any behaviour disrupting the rest of residents is prohibited from 10:00 pm to 6:00 am. In the event of a breach of the apartment usage rules, the person representing the Nearto.pl company has the right to terminate the contract with immediate effect, without the obligation to refund the remaining booking period. 

The number of people staying in the apartment must be consistent with the number of beds. In the event of a breach of this point, Nearto.pl has the right to terminate the Agreement with immediate effect, without the obligation to refund the amount due for the remaining booking period. In particular, the Customer may not rent the apartment to third parties or accommodate more people than the number of people for whom the apartment is intended.

There is a total no smoking policy in the apartment building and in the apartment. The customer who does not comply with the smoking prohibition will be charged with a fee in the amount of PLN 500.

For losing the keys, the Customer is charged PLN 100 for each lost set.

The customer uses the apartments and their equipment as intended. Otherwise, the customer bears full legal and financial responsibility.

In the apartments, the Customer may not conduct business or any activity contrary to the law in force in the territory of the Republic of Poland. In this case, an immediate check-out without reimbursement takes place, and Nearto.pl apartments do not bear any responsibility for activities that took place during the Client’s stay.

The customer is responsible for the actions and omissions of persons staying in the apartment with the Tenant, in particular for minors. Minors may live in the apartment only with adults. Minors may live in the apartment without an adult, provided that the person who made the reservation/guaranteed by credit card is an adult (taking full responsibility for the underage participants of the reservation) who accepts the company regulations before checking in and sends a signed lease agreement by e-mail 24 hours from the moment of receiving the lease agreement.

Pets are not allowed. The Customer obliges to not keep animals in the Apartment.

  1. Landlord’s liability

Nearto.pl apartments do not bear any responsibility for injuries or damages incurred by the Customer during their stay in the Apartments, in particular for injuries or damages resulting from improper use of the apartments and their equipment. The customer bears sole and full responsibility in this respect, including having appropriate insurance during the stay in the apartments.

  1. Responsibility of the Nearto.pl apartments

Nearto.pl apartments are obliged to:

Fulfilment of the contract of renting the apartments, in particular providing the client with clean, fully functional apartments with equipment, according to the information contained in the offer available on the website.

Cleaning the apartments before the Client’s arrival.

Telephone accessibility for customers from 10:00 am to 6:00 pm (and in justified cases outside of these hours) and solving any problems that may arise in a time adequate to the problem.

Undertaking negotiations to reduce or reimburse the cost of the service in justified cases, when the problems reported by the client are not resolved and will significantly reduce the quality of the client’s stay in the apartments.

The responsibility of the Nearto.pl apartments does not exceed the total cost of the reservation.

  1.   Placeholder.

In the event of unpredictable circumstances which effects cannot be immediately eliminated by customary means, Nearto.pl reserves the right to offer the Customer a replacement facility similar to the one originally booked. Nearto.pl has the right to withdraw from the Contract in case of force majeure events. This also applies to cases in which the Customer’s personal security or property, for reasons beyond the control of Nearto.pl, cannot be guaranteed. The amounts paid by the Customer are immediately refunded, minus the amounts due for the services already rendered.
